Practice
There are several strands to Andrew Moran’s practice deriving from over 30 years of practice in three cities, London, Liverpool and Manchester.
Shipping & Maritime:
Andrew's practice includes all types of marine accident, pollution, dangerous cargo damage to vessels, regulatory prosecutions, charterparty and bills of lading disputes and ship sale and construction disputes.
He has appeared in cases in the Admiralty Court and LMAA Arbitrations including the Resumed Formal Investigation into the loss of the Bulk Carrier, MV Derbyshire, The Sea Empress, The Robert “M” (the ship which sank in dry-dock!). He has acted in many cases involving personal injury in accidents at sea, on offshore installations and in ports and harbours.
He has a particular speciality in claims and prosecutions arising from marine and river pollution.
Commercial:
He has acted in all kinds of contractual disputes arising in a myriad of circumstances. He has acted in corporate disputes involving allegations of breach of trust and breach of directors’ fiduciary duties, the making of secret profits and diversion of corporate opportunities. He has acted in all sorts of claims of fraudulent behaviour arising in all sorts of circumstances. He has acted in numerous insurance disputes of all types including, recently, a multi-billion dollar re-insurance claim concerning interpretation of back-to-back policies incepted in different jurisdictions in respect of pollution to North American River systems by mining operations in several U.S. States.
Financial Services:
Andrew has advised and acted in financial services matters on behalf of the London International Financial Futures Exchange (LIFFE) and the International Petroleum Exchange (IPE) advising the former on the content of its rules and trading procedures. He has acted as Chairman of, and/or adviser to, Disciplinary Tribunals in both LIFFE and the IPE. He is appointed as Chairman of the Disciplinary Panel of the International Petroleum Exchange, under the auspices of the City Disputes Panel, until 2010. He has acted in numerous cases concerning breach of regulatory obligations and contraventions of the Financial Services and Markets Act.
Regulatory Matters:
Andrew has an extensive practice in a wide range of regulatory matters in various fields. This includes a speciality in matters of professional negligence across a wide range of disciplines.
